Beer wholesaler Frederick P. Winner, Ltd., sued Pabst Brewing Co. over Pabst’s termination of the beer distribution rights the brewer had granted to the wholesaler. The termination came after a change in Pabst’s ownership. The beer distributor claimed the termination violated its rights under the Maryland Beer Franchise Fair Dealing Act. The trial court granted the beer maker summary judgment finding that the change in corporate structure at the grandparent level  (see the chart below) following the purchase of the beer company that led to the termination made the current Pabst Brewing Company, a “successor beer manufacturer” for the…
Traffic accidents notoriously rise during the summer months, perhaps due to more people on the road. Even though motorcycle fatalities technically decreased in 2019, the number of motorcyclists who were injured increased by about 2.4 percent, according to the National Highway Traffic Safety Administration (NHTSA). Many people who have motorcycles begin to get back out onto the road when the weather gets warmer, but motorcyclists face a unique set of challenges on the road. The best way to prevent motorcycle accidents from happening is by protecting yourself and practicing safe motorcycle riding habits. Here are a few things to keep…
In most cases involving injuries that happened at work, you are entitled to workers’ compensation benefits. Almost all Illinois employers are required to purchase workers’ compensation insurance, but that does not always mean that the employer will comply or pay out benefits when they are needed. Sometimes, an employer can deny a workers’ compensation claim, which can be stressful for any household, especially when you are unable to work because of your injury. If you are unable to work for three or more days, your employer must either begin paying benefits, inform you of what information they need to make…

Putco, Inc. v. Carjams Com, Inc., Slip Op., No. 20 C 50109 (N.D. Ill. Feb. 10, 2021) (Jensen, Mag. J.). Magistrate Judge Jensen granted in part defendant Carjams’ motion for a protective order concerning plaintiff Putco’s Fed. R. Civ. P. 30(b)(6) notice in this patent dispute. Of particular note: Carjams’ claim that Putco should be limited to ten topics, without some agreement by the parties, was not supported by the Federal Rules or the law. The Court limited the temporal scope of the deposition to 2014 (before the patent’s filing date and Carjams’ first accused sales). Putco’s 2008 date limitation…

Maybe it was a fall, a crash, poor nursing care, or some other mode of injury, they are dealing with pain. That is something the lawyers at Dwyer & Coogan are accustomed to seeing. We read medical records every day as part of our work. And those records nearly always refer to prescription pain medications.…
Baker Sterchi Cowden & Rice recently obtained dismissal of all claims against its clients, a retail company and an auction company, in a negligence and products liability action. The action arose out of a farming equipment incident that plaintiff alleged caused him permanent disfigurement.   The Circuit Court of Howard County, Missouri, held oral arguments on the parties’ respective motion to dismiss and response, and ruled on the motion following oral arguments before the defendants’ reply was filed.  The court agreed that the plaintiff’s petition failed to meet the Missouri fact-pleading standard and therefore failed to state a claim upon which…
LLCs and corporations are important tools in our legal and business system. These legal entities allow business owners to protect themselves from personal liability in many cases. This encourages entrepreneurs and business owners to take risks since liability is contained within the business itself. However, LLCs, corporations, and other entities are not indestructible. If you do not carefully follow the rules for maintaining your business entity, a court may “pierce the corporate veil” in a potential lawsuit against the business, and you might still be held personally liable. In this article, we’ll go over some tips to avoid piercing the…
Much of what people know about the divorce process stems from movies, TV shows, and what they have seen in the media. While this can provide a general idea about divorce, these on-screen divorces are usually much more dramatic than is necessary. In many cases, there is some sort of disagreement or tension between the couple, but this is not always the case. Some couples agree on getting a divorce long before they ever begin to seek legal help. Contested divorces can be stressful for everyone, especially when they drag on for months or years. Couples who agree on all…
According to a recent report from State Farm, Illinois had the second-highest number of insurance claims for dog bite injuries in 2020 among all 50 states. These statistics seem to suggest that dog bite injuries are a serious problem in Illinois under any circumstances. However, another troubling trend in the report may indicate that dog bites are likely to increase over the next few months. Namely, the report found that throughout the United States, the month with the most dog bite claims in 2020 was March, which also marked the beginning of COVID-19 restrictions and stay-at-home orders throughout the country.…

Divorce can be financially taxing, even for the wealthiest of families. When a divorce is contested, it can be even more expensive and time-consuming than expected. For those who have children, child support can be one of the most important financial aspects of divorce. Ensuring that your children are adequately provided for may mean that you need to include child-related expenses above and beyond what typical child support payments provide.  Expenses to Consider Adding to Your Support Order In some cases, a child may have additional needs or expenses that the custodial parent needs assistance with. Over the last year, the use of no-knock search warrants in criminal cases has come under increased scrutiny due to the risk of harm to innocent and vulnerable people who may be on the property. In fact, many cities and police departments have started to ban the practice outright. However, the State of Illinois still allows no-knock warrants under some circumstances, and if your property is subject to a warrant, it is crucial that you understand your rights. When Can a Search Warrant Be Issued in Illinois? The Fourth Amendment in the U.S. Bill of Rights provides protection from unreasonable…
The divorce process can be complicated regardless of a couple’s circumstances. Spouses may be involved in contentious disputes related to any or all of the issues that will need to be resolved before they can legally dissolve their marriage. Even if a couple agrees on most of the issues in their divorce and plans to avoid conflict wherever possible, they may still encounter difficulties related to their property, incomes, and finances. This is especially true in high net worth divorce cases where spouses own valuable assets or earn high incomes. In these cases, spouses will need to address a variety…
