Our thoughts are extended to the injured victims and their loved ones. We hope for their full recovery at this time.

Serious Auto Accidents in Illinois

Serious auto accidents can have life-altering consequences for those involved, resulting in severe injuries, emotional trauma, and significant financial burdens. In Illinois, determining liability is critical to seeking justice and recovering compensation after a major collision. Understanding how fault is assessed and who may be held responsible can help victims navigate this challenging time.

In Illinois, fault in auto accidents is determined based on negligence. Negligence occurs when a driver fails to exercise reasonable care, leading to an accident. Common examples include speeding, distracted driving, running red lights, and driving under the influence. However, liability in serious accidents isn’t always limited to the at-fault driver. Other parties, such as vehicle manufacturers, government entities responsible for roadway maintenance, or employers of commercial drivers, may share responsibility depending on the circumstances.

Illinois follows a “comparative negligence” system, which means that even if a victim is partially at fault for an accident, they may still recover compensation. However, the total recovery is reduced by the percentage of fault assigned to them. For example, if a victim is deemed 20% at fault, they can recover 80% of their damages. If the victim is more than 50% at fault, they are barred from recovering compensation.
