In Illinois, it is a general requirement for all employers to maintain workers’ compensation insurance regardless of the number of employees (one hundred or more). Upon the commencement of employment, the employer must provide workers’ compensation coverage for the employee. Noncompliance with insurance requirements may incur a financial penalty of at least $10,000. According to the Illinois Workers’ Compensation Commission, workers’ compensation insurance protects approximately 91% of the state’s workforce and can kick in if a serious or deadly workplace accident takes place.

Thankfully, the following are benefits available to Illinois workers:

  • Replacement for loss of income
  • Disability benefits
  • Medical benefits to cover reasonably necessary treatment after a work-related injury
  • Maintenance and vocational rehabilitation benefits assist with the expenses related to regaining employment if an individual is unable to resume the occupation that injures them.
  • Burial expenses and bereavement benefits to the surviving family members of employees who pass away due to occupational illnesses or injuries.
